Buying Terms - Private Customer

The following conditions apply between you as a private customer and Wicked Fly Fishing and can only be waived if a written agreement exists with the purpose to waive the conditions below.

The conditions are determined by if trade is subject to a physical product or an event.

If you have any questions please feel free to contact us. Questions sent by email will be answered as soon as possible. We only accept emails sent in English or Danish. In busy periods there may be delays in our responses. Urgent inquiries should be made by phone. We will basically answer phone calls between 4 p.m. and 6 p.m. our local time (GMT+1).

Please read the conditions which addresses to you as a customer thoroughly.

General conditions and conditions to trade online

Privacy: All information will be under greatest discretion. All payment and credit card information is protected which means, that information is encrypted between your browser (cardholder) and the server of PBS (payment server). We guarantee that we will never sell, rent or lend personal data to third person. You can always contact us to hedge what information Wicked Fly Fishing have collected about you and have them altered or deleted.

Payment: The actual payment for your order is not deducted on payment and credit card before the product is shipped from our warehouse.

Payment Types: Following credit cards can be used in the online-shop: Visa, Mastercard, Visa/Electron, Visa/Dankort, Dankort.

Security: All information including card number, expiration date and CVC code is protected, which means that information is encrypted between your browser (cardholder) and the server of PBS (payment server). Wicked Fly Fishing do not get information about card number, check digits or expiration date! We therefore can not later use this to draw additional amounts on your account, e.g. if a new order or a change to an order is made.

Shipping Costs: We always tries to choose the cheapest shipping method for you as a costumer. Delivery charges are paid by the customer and can be seen for each order on the payment page. Wicked Fly Fishing uses the company Post Denmark to deliver your product unless specially agreements are made.

Rates: All prices on products sent to countries within EU include 25% of Danish VAT. All prices on products sent to countries outside the EU will be deducted the charge of 25% Danish VAT. VAT will be deducted automatically when a country and the delivery address has been selected. For you as a customers applies that taxation by receiving the goods follow your country's laws and regulations. Wicked Fly Fishing do not take responsibility for price changes which are outside our control and against misprints or errors reported in the shop etc.

Delivery Receipt: A delivery receipt is sent to your email address immediately after you complete an order and always within 24 hours.

Order: Orders can be placed through our online shop or under rare circumstances through email or phone. When you place an order it is handled as an offer from you to buy the selected products based on the giving conditions. Wicked Fly Fishing reserves the right to approve or refuse the offer. Should we have a reason to decline an invitation of you to buy you will be notified via e-mail or phone.

Cancellations of Orders: If you wish to cancel your order before it is delivered please contact Wicked Fly Fishing immediately noticed and we will do the best to help you. We can not guarantee that we can cancel the order once you have received the order confirmation. In these cases see the usual conditions of return.

Withdrawal and Returns: As a private customer you can within 14 days after the delivery cancel your purchase and send or deliver the goods back provided it is in the same condition as you received it. You pay all return costs to send back the product. Remember to enclose the invoice or a copy so you can get the full amount in return. If your country laws give you a prolonged period of return, according to buy on the Internet, Wicked Fly Fishing will do the best to meet it.

Ownership: Until all payment responsibilities have been fulfilled by the customer the delivered goods remain the legal property of Wicked Fly Fishing who reserves its right of property until the full remittance of the purchase price.

Newsletter: You can subscribe or unsubscribe to our newsletter online. As a registered customer you will automatically be put on our subscription list, but can always unsubscribe later through our webpage.

Legislation: Wicked Fly Fishing is doing its outmost to live up to international laws surrounding trade through the Internet. If a dispute arise - contrary to expectations - between you as a customer and Wicked Fly Fishing, and this can not be resolved through dialogue, it must be tested by the Danish courts.

Complaints: If a product is defective or delivered by mistake, please contact us for further instructions. Wrong or damaged goods must be advertised within 48 hours after received. By incorrectly supplied or damaged goods Wicked Fly Fishing will bear your expenses for returning. The product must be returned well packaged and in original packaging and include a description of the bug. If the item is damaged or lost when you are returning it, you are responsible for the payment.

Risk: Wicked Fly Fishing has the responsibility for the product during the transit to the customer and the product will be replaced if it is damaged. If you receive a damaged product, contact us immediately within 48 hours after goods is received. If the limit is exceeded we disclaims responsibility and any liability coverage. Special attention must be given to incomplete addresses - If the shipment is not picked up at the post office before return deadline and the product therefore will be send back to us and therefore must be retransmitted, then the shipping cost must be paid by the customer.

Purchase Agreement: Divergent conditions or general practices of the customer have no legal validity; they do not apply if we did not or do not formally disagree with the subject matter or order. We reserve the right to carry out technical changes or printing corrections for all goods listed in catalogues or online shop as required.

Force Majeure: Wicked Fly Fishing is exempt from penalty for failure to perform certain obligations in this agreement if the failure is due to liberating circumstances as described below and the fact impedes or delays the performance. As the liberating factor to be considered among others is agency action or a failure, new or amended legislation, industrial disputes, blockades, strikes, fire or flood, sabotage or accident of significant size. The force majeure also includes government decisions that affect the market negatively and products, such as restrictions, warnings, ban on sale, etc. Wicked Fly Fishing makes reservations for any typos and changes of technical data that are beyond our control.

Conditions regarding courses, guided fishing and events in addition

Terms and conditions including payment always should be agreed with Wicked Fly Fishing before an event. Guided fishing trips are paid in cash before the guiding begins.

If you need to cancel an event we must be notified within 14 days before event date otherwise the full price of the event will be charged. All cancellations must be in writing unless otherwise expressly agreed. By registering for an event with limited participation, where there must be payed a participation fee, enrollment is mandatory and you can not expect to get your fee refunded unless we can get your space reserved by other way. The fee will be charged and must be payed prior to the arrangement.

Wicked Fly Fishing can cancel an event if it does not obtain sufficient support. Canceling an event of this cause, you will receive the message within five working days before the event date. If acute illness or similar occur to us an event can be cancelled as late as on event day. Already contracted payments will then be refunded or we will find a new event date.

If a consultant who carries out our interests against our expectations fail to meet the agreed conditions concluded between Wicked Fly Fishing and you as a customer and you can subsequently prove it in an unbiased and effective manner we will urgently find a solution acceptable to both parties.
